CONTRACTUAL CONDITIONS FOR USE OF THE WEBSITE  

Window On Web is a website owned and managed by Publifoto Verona Via Apollo XI, 4a San Giovanni Lupatoto Verona Italy PI 00791790231, and aims to be a "window" for professionals in the field of creative works and art in all its forms.

Publifoto Verona gives users the ability to manage independently their own space on the web, so that they can publicise their own image in an environment that is intended to be a clearing house of supply and demand of works of art and creativity.

These contractual conditions are aimed and written with a professional kind of counterpart, given that the services on offer are not intended to be for private use or for any purposes other than advertising and commercial.

Publifoto Verona does not guarantee nor does it strive to guarantee a minimum number of visits to the individual pages purchased or to the website itself.

Use of the website is subject to the following conditions, which the Underwriter expressly accepts:  

Requirements for use

Registration and use of the web space will be considered null and void if not allowed by applicable law. By registering, the Underwriter declares and guarantees that:

(a) all the personal information submitted is truthful and accurate;

(b) personal information will be updated;

(c) use of their web space does not violate any law or applicable regulation on the subject or restrictions by the judiciary authority.

Should Publifoto Verona believe that the publication of any information on the website is in violation of these requirements, it reserves the right to bar the user from using the website without prior warning.

Fees and duration

At the present time no fees are due to subscribe but it is possible that in the future some things will change. In this case the user will be preventively informed that, after registering, the user will be asked to pay the amount published on the website, thereby purchasing a webpage where they can publicise their own image for a year from the date of registration.

Publifoto Verona reserves the right to change the user fees upon renewal, at the end of each year of use.

In the event of violation of contractual obligations, the Underwriter can be barred from using their web space at any time and without prior warning.

The Underwriter can cancel their subscription at any point without prior warning.

If, following a violation of these conditions, the user is barred from using the website, or if they cancel their subscription before the expiration date of use, the fees paid when signing up will not be reimbursed.

Liability for published content

Publifoto Verona reserves the right to carry out checks on the published content, after which it has the power to eliminate any content that it deems to be a violation of this contract or offensive, illegal, damaging to the rights of others or a threat to anybody's safety.

The Underwriter expressly exempts Publifoto Verona from any liability that might arise from the publication of material as described above, even in cases when the abovementioned check is carried out, without any obligation for Publifoto Verona to perform that check and remove or change inappropriate content.

The Underwriter is the only person liable for the content published in the web space given to them by this contract, as well as for the material or information conveyed to visitors.

Publifoto Verona does not check content before it is published and is not obligated to offer guarantees, whether express or implicit, for the accuracy and reliability of the content itself.

Prohibited activities or content

Among the content that the Underwriter is not allowed to publish in their web space are any expressions or content which in any way:

1. are blatantly offensive or incite racism, intolerance, hate or physical violence against any group, community or individual;

2. contain pornographic, violent or offensive material or include one or more links to adult websites;

3. include information known to be false or deceptive or instigate illegal activities or behaviour that might constitute abuse, threats, obscenity, defamation or slander;

4. instigate illegal or unauthorised copying of third party works protected by copyright, and offer pirate copies or provide one or more links to material that has been illegally taken or counterfeited;

5. include the unauthorised publication, change, reproduction and distribution of content protected by copyright or trademarks and of other proprietary information without express consensus from the person entitled;

6. imply the distribution of junkmail, chain letters or unsolicited mass mailing, instant messaging, spimming or spamming,

7. include pages with limited access or requiring a password or hidden pages or images that are not connected to/from other accessible pages;

8. incite illegal activities or undertakings or provide information and/or instructions on illegal activities, such as, but not limited to, for example, the manufacturing or purchase of illegal weapons, the violation of the privacy of others or the spread and creation of computer viruses.

The listing above is not obligatory, since the publication of any content, in any form that is illegal or offensive, is strictly prohibited.

Any violation of the contractual obligations just mentioned could cause the removal of the content in question, as well as cancellation of the Underwriter's subscription, with subsequent barring from use of services, without any reimbursement of service fees.

Publifoto Verona also reserves the right to take legal action to protect itself and seek compensation for any damage caused by behaviour that it considers illegal or in violation of the obligations contained in this contract.

Privacy

The Underwriter's personal details are processed in full compliance with the requirements established by Italian law as well as by European Union regulations, through the model of information and consent to the handling of personal details on the website.

Applicable law and tools for composing disputes

1. Italian law applies to this contract;

2. for all disputes regarding or connected to this contrast that might arise between parties, they are obligated to attempt to reconcile their differences, as outlined in the reconciliation regulation of the Verona Chamber of Commerce;

3. in the event of failed reconciliation, these disputes will be resolved by a single arbiter, in accordance with the arbitration procedures described in the Regulation of the Chamber of Arbitration set up by the Verona Chamber of Commerce. The arbiter will decide according to standard procedures, in accordance with law and in compliance with the Regulation of the Chamber of Arbitration of Verona, current at the time of signing this agreement, and the binding regulations of the Italian Civil Procedure Code.

Access to the contract

1. a copy of these General Conditions can be downloaded and saved to the Underwriter's computer, by clicking on "download general conditions" . A copy of the order of access to the service forwarded by the Underwriter is saved in electronic format in the servers of Publifoto Verona, and can be provided upon request to the Underwriter, in electronic format to the e-mail address indicated by the customer and at no additional cost, or in hard copy for the price of reproduction and delivery.

ACCEPTANCE BY OBLIGATORY CHOICE FOR THE PURPOSE OF CONTINUING WITH REGISTRATION PROCEDURE.
